These terms govern your use of “Will They Stay?” (the “site”), operated by Peak Employment Solutions (“Peak,” “we,” “us”). By using the site you agree to them. If you do not agree, please do not use the site. See also our Privacy Policy.
What the site is
The site offers free educational resources: a short quit-intention check, manager training, and a pre-hire guide. They are provided for general information, reflection and conversation.
How you may use the assessment
- Do not use any result to make or justify an employment decision about an identifiable individual, such as hiring, firing, promotion, discipline or pay.
- Do not try to identify who gave which answer in a team survey, and do not pressure anyone to take part or to answer in a particular way.
- If you run a team survey, you are responsible for telling your people accurately how it works, for the way you use the results, and for following the law that applies to you.
- Answer honestly and for yourself. Do not submit false information, attempt to bypass limits such as one-time codes, or interfere with the site, its security, or its servers, or use automated means to submit forms.
Your information
You are responsible for the accuracy of the information you give us and for having the right to give it. We handle it as described in the Privacy Policy.
Our content and trademarks
The site, its text, design, and training and guide materials belong to Peak Employment Solutions or its licensors and are protected by law. The Six Unmeasurables™ and Before Day 1™ are trademarks of Peak Employment Solutions. You may read the materials, print them for your own organization’s internal use, and share a link to the site. You may not sell, republish or redistribute them, present them as your own, or remove the notices on them, without our written permission.
Third-party links and sources
The site links to other websites and cites outside research. We do not control those sites and are not responsible for their content. Statistics and studies are cited for context, and you should consult the original sources before relying on them.
No warranties
The site and all content are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and uninterrupted availability. We may change, suspend or remove any part of the site at any time.
Limit of liability
To the fullest extent the law allows, Peak Employment Solutions and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business decisions, arising from your use of or reliance on the site. For anything the law does not let us exclude, our total liability for all claims will not exceed one hundred dollars ($100). You agree to use the site at your own risk.
Governing law
These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in or serving Richmond County, Georgia, and you consent to their jurisdiction.
